Chairman of Groupe Nduom, Dr. Papa Kwesi Nduom, stated that Ghana’s current political climate is highly favorable for business recovery and national prosperity following the Court of Appeal’s decision to reinstate the operating licence of GN Bank. This ruling, which occurred recently, quashed a High Court decision and ordered the return of the company’s assets and operations to its shareholders.
Context of the Banking Sector Cleanup
The restoration of GN Bank’s licence comes after a tumultuous period for the Ghanaian banking sector. In 2017-2019, the Bank of Ghana (BoG) undertook a significant cleanup exercise, revoking the licences of several financial institutions due to alleged mismanagement, liquidity issues, and capital deficiencies. This exercise led to the collapse of numerous banks and savings and loans companies, causing widespread job losses and financial distress for depositors and stakeholders.
GN Bank, which was later converted to GN Savings and Loans, was among the institutions affected by this cleanup. The revocation of its licence plunged the company into a prolonged legal battle, impacting its operations and the livelihoods of its employees and customers.
Court Overturns Revocation, Cites Unfairness
The Court of Appeal’s unanimous decision found the Bank of Ghana’s revocation of GN Bank’s licence to be unfair and unreasonable. This ruling marks a significant turning point for the company after nearly seven years of legal and financial challenges.
The appellate court’s order for the receiver to return control and management of the company’s assets and operations to its shareholders provides a clear path for GN Bank to resume its business activities.
Dr. Nduom Expresses Hope Amidst Painful Past
Speaking after the court’s ruling, Dr. Nduom highlighted the positive political environment in Ghana, describing it as a catalyst for change and renewed hope. He believes this atmosphere will enable businesses like GN Bank to recover and contribute effectively to national development.
