Former Attorney-General Godfred Dame has publicly accused Deputy Attorney-General Justice Srem Sai of misleading the public regarding legal access for former National Food Buffer Stock Company CEO Abdul-Wahab Hanan, who was recently re-arrested by the Economic and Organised Crime Office (EOCO). The dispute centers on whether Hanan’s legal team was granted access to their client during his detention.
Dispute Over Legal Access
Speaking on Asempa FM’s Ekosii Sen program, Mr. Dame asserted that lawyers representing both Mr. Hanan and his wife were denied access to their clients for a period of two days while they were in EOCO custody.
“It’s untrue. The lawyers from our office were there. It started on Tuesday; the lawyers were there for a long while and continued to yesterday, but were denied access,” Mr. Dame stated, directly refuting claims made by Deputy AG Srem Sai.
He further elaborated that while food was permitted to be delivered to Mr. Hanan during this period, a lawyer attempting to accompany the delivery and meet with the client was prevented from doing so. This highlights a significant procedural disagreement concerning the rights of a detained individual to legal counsel.
Questions Surrounding Detention and Charges
Mr. Dame also raised concerns about the lack of new charges or substantial evidence presented against Mr. Hanan following interrogations conducted on Thursday. He questioned the rationale behind continued detention if authorities lacked a compelling case.
“Today, there was an interrogation. No new charges; there was no fresh evidence,” he revealed. “If it was true they were looking for him and didn’t find him, then why were they keeping him?” he asked, implying a potential lack of grounds for continued custody.
The former Attorney-General emphasized the principle that meaningful interrogation of a represented suspect should not proceed without the presence of legal counsel. This stance underscores a fundamental aspect of due process and the right to legal representation.
Broader Implications for Legal Proceedings
The public disagreement between two high-ranking legal officials raises questions about transparency and adherence to legal protocols within the justice system. The situation highlights the critical importance of ensuring access to legal counsel for individuals in state custody, a cornerstone of fair legal proceedings.
The controversy could lead to increased scrutiny of EOCO’s detention and interrogation practices. It also underscores the ongoing tension between investigative bodies seeking to gather evidence and the rights of individuals to legal representation during such processes.
What to Watch Next
Moving forward, the public will be watching to see if any official clarification or investigation into the alleged denial of access occurs. The development of new charges, or the release of Mr. Hanan, will also be key indicators of the strength of the case against him. Furthermore, this incident may prompt a review or reinforcement of guidelines concerning lawyer-client access during detentions within Ghana’s legal framework.
