Accra, Ghana – The African Women Lawyers Association (AWLA) has intensified its advocacy for urgent reforms to Ghana’s spousal property laws, citing years of legislative inaction that continue to foster uncertainty and injustice for families. Speaking at a press conference recently, AWLA highlighted Parliament’s failure to fully enact legislation as mandated by Article 22 of the 1992 Constitution, which outlines the property rights of spouses.
Decades of Legal Ambiguity
The absence of a clear, comprehensive legal framework has compelled Ghanaian courts to adjudicate property distribution disputes on a case-by-case basis. This has unfortunately led to inconsistent judicial decisions over the years, creating significant uncertainty, particularly in lower courts.
